Victim identified in fatal California boardalk hit-run; suspect arrested

A California man was held on suspicion of murder after a car plowed through Los Angeles' popular Venice Beach boardwalk Saturday night, killing a young Italian woman in the U.S. for her honeymoon and injuring 11 other people, authorities said Sunday.

Police said Nathan Louis Campbell, 38, of Los Angeles, was being held on $1 million bail after he fled the scene in a dark sedan in an incident that was captured on security camera video.


The video shows a man parking a black car along the boardwalk, watching for several minutes and then speeding into the crowd about 6 p.m. (9 p.m. ET).?It shows the car careening around barriers intended to block automobiles from reaching the boardwalk's pedestrian area.

Alice Gruppioni, 32, of Italy was killed, the Los Angeles County coroner's office told NBC News. Eleven other people, all of them believed to have been pedestrians on the boardwalk, were injured, one of them critically.

The Italian news agency ANSA reported that Gruppioni, of Bologna in northern Italy, was married July 20 to Christian Casadei, an architect from Cesena.

Casadei suffered minor injuries and was at his wife's side when she died, it said, quoting Giuseppe Perrone, the Italian consul general in Los Angeles, who accompanied Casadei to the hospital.

Perrone told ANSA in a telephone interview that Casadei and his new wife were strolling along the boardwalk when the car came barreling through.

"We were walking, we were happy, we were on our honeymoon and everything, and suddenly everything changed," Casadei said, according to Perrone.

"I still can't believe it, and I don't even remember exactly what happened. It's all very confusing."

Perrone described Casadei as "destroyed and in disbelief."

Witnesses said it appeared that the driver took aim at people on the boardwalk.

"All I saw was a car emerging from the crowd driving southbound on the boardwalk just plowing through whomever was in its way," said Scott Levinsky, a vendor at the packed tourist attraction.

"We're never going to forget that moment," he said. "I'm still thankful to God that we are still alive and surviving."

Chelsea Alvarez, who was visiting the boardwalk Saturday night, said the scene was "really bad."

"There was tables, there was people everywhere, blood everywhere," she said. "There was scattered stuff. It was horrible. It was the ugliest scene I've ever seen."

Alvarez told NBC Los Angeles that her grandmother Linda Alvarez, 75, was among those hit, suffering broken ribs.

"She's good. She's just resting. She's sleeping right now," Alvarez said.

Los Angeles City Council member Mike Bonin told the station that the barriers in place at the Venice boardwalk are insufficient. He said he would ask the council to move quickly to install new barriers before the end of the year.

Gruppioni was the daughter of Valerio Gruppioni, president of Sira Group, based in Bologna, one of the world's largest producers of radiators for heating. Bologna FC, a club in the top flight of Italian soccer, confirmed her death in a statement offering condolences to Valerio Gruppioni, a former president of the club.

"President (Albano) Guaraldi and all of Bologna FC are with the Gruppioni family in this time of unspeakable pain," the club said.

In a statement Sunday, rival club AC Milan, one of the world's premier teams, expressed its "condolences to former Bologna president Valerio Gruppioni and his family following the passing of his daughter Alice."

Oil companies frack in coastal waters off California

SAN FRANCISCO (AP) - Companies prospecting for oil off California's coast have used hydraulic fracturing on at least a dozen occasions to force open cracks beneath the seabed, and now regulators are investigating whether the practice should require a separate permit and be subject to stricter environmental review.

While debate has raged over fracking on land, prompting efforts to ban or severely restrict it, offshore fracking has occurred with little attention in sensitive coastal waters where for decades new oil leases have been prohibited.

Hundreds of pages of federal documents released by the government to The Associated Press and advocacy groups through the Freedom of Information Act show regulators have permitted fracking in the Pacific Ocean at least 12 times since the late 1990s, and have recently approved a new project.

The targets are the vast oil fields in the Santa Barbara Channel, site of a 1969 spill that spewed more than 3 million gallons of crude oil into the ocean, spoiled miles of beaches and killed thousands of birds and other wildlife. The disaster prompted a moratorium on new drill leases and inspired federal clean water laws and the modern environmental movement.

Companies are doing the offshore fracking - which involves pumping hundreds of thousands of gallons of salt water, sand and chemicals into undersea shale and sand formations - to stimulate old existing wells into new oil production.

Federal regulators thus far have exempted the chemical fluids used in offshore fracking from the nation's clean water laws, allowing companies to release fracking fluid into the sea without filing a separate environmental impact report or statement looking at the possible effects. That exemption was affirmed this year by the U.S. Environmental Protection Agency, according to the internal emails reviewed by the AP.

Fracking fluids can comprise hundreds of chemicals - some known and others that aren't since they are protected as trade secrets. Some of these chemicals are toxins to fish larvae and crustaceans, bottom dwellers most at risk from drilling activities, according to government health disclosure documents detailing some of the fluids used off California's shore.

Marine scientists, petroleum engineers and regulatory officials interviewed by the AP could point to no studies that have been performed on the effects of fracking fluids on the marine environment. Research regarding traditional offshore oil exploration has found that drilling fluids can cause reproductive harm to some marine creatures.

"This is a significant data gap, and we need to know what the impacts are before offshore fracking becomes widespread," said Samantha Joye, a marine scientist at the University of Georgia who studies the effects of oil spills in the ocean environment.

The EPA and the federal agency that oversees offshore drilling, the Bureau of Safety and Environmental Enforcement or BSEE, conduct some routine inspections during fracking projects, but any spills or leaks are largely left to the oil companies to report.

In a statement to the AP, the EPA defended its oversight of offshore fracking, saying its system ensures the practice does not pollute the environment in a way that would endanger human health. Oil companies must obtain permits for wastewater and storm water discharges from production platforms that "ensure all fluids used in the drilling and production process will not adversely impact water quality," the statement said.

Oil companies also say that much of the fracking fluid is treated before being discharged into the sea. Tupper Hull, spokesman for the Western States Petroleum Association, said fracking in general is safe and has "never been associated with any risk or harm to the environment" in over six decades in California.

California coastal regulators said they were unaware until recently that offshore fracking was even occurring, and are now asking oil companies proposing new offshore drilling projects if they will be fracking.

Because the area of concern is located more than three miles off the state's shoreline, federal regulators have jurisdiction over these offshore exploration efforts. However, the state can reject a permit in federal waters if the work endangers water quality.

"It wasn't on our radar before, and now it is," said Alison Dettmer, a deputy director at the California Coastal Commission.

Government documents including permits and internal emails from the BSEE reveal that fracking off the shores of California is more widespread than previously known. While new oil leases are banned, companies can still drill from 23 grandfathered-in platforms in waters where endangered blue and humpback whales and other marine mammals often congregate.

In March, a privately held oil and gas company received permission from the agency to frack some 10 miles off the Ventura County coast. The job by DCOR LLC involves using the existing wellbore of an old well to drill a new well. Three so-called "mini-fracks" will be done in an attempt to release oil locked within sand and rocks in the Upper Repetto formation.

Only a month before the application was approved, however, an official with the BSEE voiced concerns about the company's proposed frack and whether the operation would discharge chemicals into the ocean.

"We have an operator proposing to use 'hydraulic stimulation' (which has not been done very often here) and I'm trying to run through the list of potential concerns," Kenneth Seeley, the BSEE's regional environmental officer for the Pacific, wrote in a Feb. 12 email to colleagues. "The operator says their produced water is Superclean! but the way they responded to my questions kind of made me think this was worth following up on."

BSEE officials approved DCOR's application on March 7. The agency told the AP that DCOR's job would use far less fracking fluid than an onshore operation.

"For comparison, well stimulation offshore typically uses 2 percent of the liquids and 7 percent of the sand that is used routinely for onshore hydraulic fracturing," the BSEE said in a statement.

Oil industry estimates show that at least half of the chemical-laced water used in fracking remains in the environment after an operation. Environmental groups say as much as 80 percent of the fluids can be left behind. The rest gets pumped back up to the oil platform, and is piped or barged back to shore for treatment. Companies can also pump the fluids into an old well reservoir to discard it.

DCOR, which did not respond to requests for comment, is not the first company to try to tap more oil from California's offshore reserves, nor is the project the most extensive offshore frack here in recent years.

In January 2010, oil and gas company Venoco Inc. set out to improve the production of one of its old wells with what federal drilling records show was the largest offshore fracking operation attempted in federal waters off California's coast. The target: the Monterey Shale, a vast formation that extends from California's Central Valley farmlands to offshore and could ultimately comprise two-thirds of the nation's shale oil reserves.

Six different fracks were completed during the project, during which engineers funneled a mix of about 300,000 pounds of fracking fluids, sand and seawater 4,500 feet beneath the seabed, according to BSEE documents.

Venoco's attempt only mildly increased production, according to the documents. Venoco declined to comment.

Despite greenlighting offshore fracking projects for years, federal and state regulators now are trying to learn more about the extent of fracking in the Pacific even as officials and marine scientists scramble to weigh the environmental effects.

In January, Jaron Ming, the Pacific regional director of the BSEE, told employees in an email that there had been heightened interest in offshore fracking from within the agency and the public.

"For that reason, I am asking you to pay close attention to any (drilling applications) that we receive and let me know if you believe any of them would be considered a 'frac job.'"

That same month, BSEE estimated in internal emails that only two such jobs had occurred off California in the past two decades. But weeks later, as the agency worked to respond to public requests about fracking offshore, emails show it had found 12 such instances of offshore fracking.

BSEE said it cannot be sure just how often fracking has been allowed without going through every single well file.

Brian Segee, a staff attorney at the Environmental Defense Center, said the uncertainty makes him skeptical about the actual number of offshore fracks. The Santa Barbara-based environmental law firm, which formed in the wake of the 1969 oil spill, is calling for a moratorium on future fracking in the Pacific until the potential environmental effects are studied.

Most fracking efforts off California have yielded mixed results. The first time Venoco fracked offshore in the 1990s, it had limited success. Chevron's one try failed. Out of Nuevo Energy's nine attempts, only one was considered very successful, according to company and BSEE records.

The practice has been more fruitful in the North Sea and the Gulf of Mexico, where it's more common and the porous nature of the geologic formation makes it easier to extract oil, according to regulators and oil industry experts. Still, oil companies surveyed by federal regulators said they haven't ruled out fracking projects in the Pacific in the future.

As fracking technology evolves and companies seek to wring production from old offshore wells, drilling experts caution that strict safety precautions and planning are needed.

Working in the open ocean, "you have to be a lot more careful to avoid any spillage," said Mukul Sharma, a professor of petroleum engineering at The University of Texas at Austin.

David Pritchard, a Texas petroleum engineer who has been working in offshore drilling for 45 years, said offshore fracking "no doubt adds complexity and risk."

One concern is that the high pressure fracking mixture in some jobs might break the rock seal around an old well bore, allowing oil to escape, added another expert, Tulane University petroleum engineering professor Eric Smith.

"I'd say it (offshore fracking) is safe," Smith said, "but nothing's a sure thing in this world."

West Springfield mayor, Town Council president disagree over setting meeting

WEST SPRINGFIELD ?Mayor Gregory C. Neffinger and Town Council President Kathleen A. Bourque have locked horns again, this time over how the council should respond to his request that it authorize using $400,000 to help purchase the Elks Lodge.

Neffinger has called a meeting of the council for 7 p.m. Monday to vote on the matter after trying unsuccessfully to get Bourque to call a meeting at that time for that purpose. Bourque responded to the mayor?s request for a meeting for Monday with a letter dated July 29 in which she explains council procedures.

She stated that the special meeting for Monday that she had scheduled earlier to set a date for a casino referendum and approve wording for a ballot question was canceled. Last month, councilors called a special meeting for that purpose. They set a referendum date of Sept. 10 was set for voters to decide whether they will approve Hard Rock Hotel & Casino New England building an $800 million casino. Councilors also approved the wording of the ballot question.

Bourque wrote that council rules call for a new appropriation to appear on two council agendas as well as be the subject of a public hearing.

?Although we have been asking for council approval on your request before a formal referral, I have decided to forego this step in the process as long as there is no objection from the town councilors,? Bourque wrote. ?The request for the appropriation will appear on the agenda on Aug. 19, 2013 and we will schedule a public hearing for that same evening. It will also be referred to the Budget Subcommittee that same evening. The request will be under new business on Sept. 3, 2013 for discussion and vote.?

Meanwhile, the clock is ticking on Neffinger?s plan to purchase the Elks Lodge on Morgan Road. He has already put down a $20,000 deposit on the property and would like to complete the purchase by Aug. 9. The mayor wants to buy the building for $450,000 and has sought $50,000 over that to deal with any expenses associated with the purchase. Earlier this summer, the council approve using $100,000 in free cash to help buy the property.

Neffinger plans to use the Elks building as temporary quarters for the West Springfield Public Library while the building that currently houses it undergoes expansion and renovation. The mayor would also like to create playing fields on acreage at the Elks property.

The mayor said he plans to use $400,000 recently given to the city by Hard Rock Hotel & Casino to help buy the Elks property.

Neffinger said Friday that he had not yet seen Bourque?s July 29 letter.

?They have many rules and procedures that can move things forward or slow things down,? the mayor said of the council. ?The sooner we purchase it (the building) the sooner we can begin preparing it for the library.?

Neffinger said Bourque was aware of his request for the $400,000 when she canceled the original Aug. 5 meeting.

Bourque could not be reached Friday to comment on the situation.

AppLock (for Android)


Tablets and phones are meant to be personal devices but they rarely stay that way. They get handed around to show off photos, to watch videos, or to play games. With AppLock (free), you can take a little of stress out of parting with your Android by keeping certain apps locked up and others freely accessible. It should be a slam dunk, but this app is held up by some odd quirks.

Using AppLock is pretty straightforward. The main page is a list of all the apps on your device which can be locked with a toggle slider to the right. AppLock also lets you lock out certain actions like calls, installing or uninstalling apps, access to settings, and accessing the Google Play store. Buttons at the bottom let you search your apps or toggle everything on or off.

From the hidden right tray, you can access the Unlock Settings menu to change your PIN or switch to a pattern lock. I found the pattern lock to be much faster and easier when using my Nexus 7 .

When you attempt to perform a locked action or access a locked app, a screen appears prompting you to login. The screen doesn't fully lock your device?you can easily navigate back to the homescreen or access the navigation tray?but it does effectively keep people out of your apps.

You can adjust which apps you want locked on the fly, or create a profile to quickly secure your device. Supporting profiles is nice a feature, especially if you have kids who want to play on your device. When they want a shot at Color Sheep, just flip the profile that locks them out of everything but a few games.

The app provides basic functionality for free, which includes locking apps and one profile. For 99 cents a month or $2.99 a year, you can unlock deeper features like time locks, a randomized keyboard, location-based locks, and other options. Unfortunately, I was unable to successfully purchase a premium upgrade on either my tablet or the Samsung Galaxy S III I also used in testing, so those features will have to remain untested, for now.

Locked Out
My main complaint with AppLock wasn't that it didn't perform as advertised?in fact, it did pretty well?but that it wasn't clear about what it was doing. During set up, the app prompted me to upgrade for "advanced protection" without any explanation as to what that involved. It turned out that this simply added email recovery for my PIN, which is a worthy feature, but to get it I had to let the app download and install an extra module and grant both the module and the app Device Admin access.

Throughout this process, the app displayed several dialog windows which should have explained what exactly was going on, but were left troublingly blank.

Creating a good impression during setup is essential, particularly for a security app and especially for an app that wants administrator access. Security is all about trust, and AppLock? still hasn't quite made me trust it. It's not just the weird start-up procedures, or the vague?frequently awkward?language used in the app, or the fact that I was unable to purchase an upgrade and unlock the premium features, it's all of those things taken together.

I don't think there's anything malicious about AppLock; it passed muster on three different security apps and both Bitdefender's Clueful Privacy Advisor and Lookout Mobile Security indicate that it's not connected to ad networks. But the fact that I felt compelled to check gives me pause.

Still Looking
Out of the box, AppLock solves a very common problem: how to share your device without making it totally public. It's a useful tool for people with grabby roommates, or kids who love to play with your Android. It can also add a second layer of protection behind your device passcode, to keep your most important apps secured.

I often say that Android apps lack polish, but this one especially needs work before it can gain my trust. There's nothing wrong with it per se, but I'm on the lookout for a slicker, more transparent app that won't make me second-guess myself.

0645 GMT - Qatar's Barwa Real Estate tumbles to a two-month low in the opening minutes of trade after the developer reports a slump in first-half earnings.

Doha's largest listed property developer posted a net profit of 199.2 million riyals ($54.7 million) for the six months to June 30, compared with 593.7 million riyals in the corresponding period of 2012.

Its shares are down 4.8 percent to 24.98 riyals ($6.87), after dropping as low as 23.90 riyals at the opening, the lowest price since May 13.

In Dubai, district cooling firm Tabreed may gain after it reported a 37 percent increase in second-quarter net profit, helped by growth in its core chilled water business and lower costs.

This is pretty cool. Fox used the UFC Phantom Cam for Saturday night's fights to slow down some of the night's biggest strikes. In MMA, strikes can happen so quickly that you can't see their true effect except through photography. With super-slow-motion, you can see what a punch or a kick can really do to the human body.

COMMENTARY | As a nurse, you can imagine my shock and horror when I read Kyle Smith's article on the New York Post's website about the McDonald's McDouble being the most nutritious and most abundant food around. Smith argues that for $1, you can get half your daily serving of protein, 20 percent of your daily serving of calcium, and even a bit of fiber with this dollar-menu favorite. But Smith's argument is riddled with so many misleading statements that I'm going to have a difficult time keeping this commentary to 350 words.

According to McDonald's own website, the McDouble has 850mg of sodium and 19g of fat. You are consuming almost one-third of your recommended daily intake of sodium and fat with one little burger. Add on a small order of "world famous fries" and that's another 11g of fat and 160mg of sodium. I suppose you could buy the apple slices instead, but the burger-and-fries combo is so iconic, it's almost a knee-jerk reaction to buy the two as a pair.

What's so bad about sodium and fat? For starters, a high-sodium diet is a major cause of high blood pressure which, in turn, is a frequent cause of cardiovascular disease. You can pretty much guess that a high-fat diet leads to weight gain and obesity. According to data collected by the CDC, in 2008 the medical care cost of obesity was more than $147 billion. And what are some of the health consequences of obesity? Among other things, high blood pressure and coronary artery disease. Those $1 McDoubles are more costly than Smith would like to acknowledge.

To Smith's credit, he points out that healthier food does cost more than cheap junk food. And anyone who has shopped at Whole Foods Market can tell you McDonald's is easier on the wallet. But the solution is not telling the cash-strapped poor and lower-middle class to run to McDonald's for lunch and dinner. We need to educate people on nutrition and tell our government to stop subsidizing junk food and put that money toward subsidizing more fruits and vegetables instead.

I agree with Smith that the McDonald's McDouble is a cheap food source that's high in protein. But make this a regular part of your diet and you'll pay a higher price in the future in terms of your health and medical bills.

'Hollywood Hillbillies' features Georgia family

BEVERLY HILLS, Calif. (AP) ? Honey Boo Boo is getting some competition.

Another family from rural Georgia is coming to reality television, with "Hollywood Hillbillies" set to debut in January on ReelzChannel.

The show follows Michael Kittrell and his grandmother Delores Hughes, known as "Mema," as the family moves from Grayson, Ga., to Hollywood. Along for the ride are Kittrell's aunt, Dee Dee Peters, her boyfriend Paul Conlon, and Kittrell's uncle John Cox.

Kittrell is known as "The Angry Ginger" on YouTube, where a video he made to protest a "South Park" episode that claimed redheads have no soul gained attention.

"I made a lot of money on my YouTube channel, and I saved it all from the past four years," Kittrell said. "I got my family with me to support me and help me while we all look for our place out here."

Alana "Honey Boo Boo" Thompson, her mother and their rural Georgia family are the subjects of a hit TLC show that focuses on their lives in a small town.

Weiner Faces Growing Calls to Quit Mayor?s Race

(NEW YORK) ? Anthony Weiner pressed ahead with his bid for mayor Wednesday despite growing calls for him to drop out over a new sexting scandal, saying the campaign is too important to abandon over ?embarrassing personal things? becoming public.

Rivals, newspaper editorial pages and at least one former New York congressional colleague urged the Democrat to quit the race a day after he acknowledged exchanging raunchy messages and photos online even after the same sort of behavior destroyed his congressional career two years ago.

?I think he should pull out of the race. I think he needs serious psychiatric help,? Rep. Jerrold Nadler, D-N.Y.

Weiner brushed off such calls and kept up his campaign schedule. He was greeted with boos as he took the stage to speak at a public housing meeting Wednesday evening, but by the end of his remarks, the crowd loudly cheered.

?I thought these things would come out by the end of the campaign, and some of them have. Look, I am pressing forward, running a campaign about the issues, and I?m getting a good response,? he said afterward.

The latest scandal erupted Tuesday after the gossip website The Dirty posted X-rated messages and a crotch shot it said he exchanged with a woman last year while using the online alias ?Carlos Danger.?

At a news conference Tuesday evening, Weiner, who has been a favorite in the polls since he launched his political comeback attempt in late May, stood side-by-side with his clearly uncomfortable wife, Huma Abedin, and said he hoped the voters would give him another chance.

Abedin, a longtime adviser to former Secretary of State Hillary Rodham Clinton, reaffirmed her love and support for her husband and said the matter was ?between us.?

Two of the city?s major newspapers, The New York Times and the Daily News, said the 48-year-old Democrat had exhausted his opportunities for forgiveness with his latest indiscretions.

?The serially evasive Mr. Weiner should take his marital troubles and personal compulsions out of the public eye? and the mayoral race, the Times wrote.

The Daily News declared Weiner to be ?lacking the dignity and discipline that New York deserves in a mayor,? and said ?his demons have no place in City Hall.?

At least three of his mayoral rivals, Public Advocate Bill de Blasio and former City Councilman Sal Albanese, both Democrats, and billionaire businessman John Catsimatidis, a Republican, said he should drop out.

?Anthony?s presence in this race has become a never-ending sideshow that is distracting us from the debate of the serious issues of this election,? de Blasio said.

City Council Speaker Christine Quinn and former City Comptroller Bill Thompson, Weiner?s strongest rivals in the polls, criticized him but didn?t directly call on him to quit.

Thompson said on WNYC-AM that Weiner should ?think about the people of this city and make the right decision,? while Quinn said at a news conference that it is up to Weiner and his family to decide whether he should end his run, but New Yorkers ?need a mayor whose is sole focus isn?t self-aggrandizement.?

Meanwhile, an NBC4NY/WSJ/Marist Poll, the first since the latest scandal broke, will be released Thursday afternoon.

Weiner has emphasized that he said when launching his campaign that more messages might emerge. But until Tuesday, he never said directly that some were sent as recently as last year.

?I regret not saying explicitly when these exchanges happened,? he told supporters in an email Wednesday.

But Weiner said the campaign was ?too important to give up because I?ve had embarrassing personal things become public.? And he said he wasn?t surprised his opponents wanted him out.

Democratic strategists in New York and Washington, where Weiner served seven terms before resigning in 2011, said there are few external means of pressuring Weiner to drop out.

Weiner has nearly $5 million to spend on the campaign, allowing him to mount a vigorous defense on television. Also, he was not particularly close to his colleagues in the congressional delegation, the strategists said, so he might be unmoved if they urge him to exit the race.

As for the voters, some want Weiner to go.

?He?s disgusting,? said magazine editorial assistant Katelin Marinari, 24.

But others said they would still vote for him.

?Do I think morally he?s wrong? Of course. But I?m not voting for a minister; I?m voting for a mayor of New York,? said public relations worker Raven Robinson, 22.

A Quinnipiac University poll released Wednesday continued to place Weiner in the top rung of Democratic contenders with Quinn and Thompson, though it was taken largely before the scandal broke.

?I have posited this whole campaign on a bet, and that is that, at the end of the day, citizens are more interested in the challenge they face in their lives than in anything that I have done, embarrassing, in my past,? he told reporters outside his Manhattan home Wednesday morning.

The unidentified woman involved in the newly disclosed messages told The Dirty that she was 22 when she began chatting with Weiner on a social networking site in July 2012, and that their exchanges lasted six months.

The Dirty posted explicit conversations of two people fantasizing about various sex acts, and ran a pixelated photo of what it said were Weiner?s genitals.

Obama halts delivery of F-16s to Egypt amid unrest

WASHINGTON (Reuters) - President Barack Obama has decided to halt the delivery of F-16 fighter jets to Egypt for an undetermined period due to the "current situation" on the ground there, the Pentagon said on Wednesday.

"Given the current situation in Egypt, we do not believe it is appropriate to move forward at this time with the delivery of F-16s," Pentagon spokesman George Little told reporters, adding Obama's decision was made with the unanimous consent of his entire national security team.

Violence has surged in Egypt since the military overthrow of Mohamed Mursi, Egypt's first democratically elected president.

Transport Canada introduces emergency rules for train safety

OTTAWA ? Transport Canada announced six emergency rail safety rules Tuesday in response to the Lac-Megantic runaway train disaster, but its senior officials declined to answer direct questions about whether it had failed in previous years to respond to weaknesses highlighted both in internal and external audits.

In a news conference responding to recommendations from Transportation Safety Board of Canada investigators last Friday, the department said the new rules would be effective immediately and in place for about six months, leading to permanent rule changes for the industry.

The new measures ban one-person crews for locomotives carrying train cars with dangerous goods. They also place new restrictions on unattended trains on main tracks, as well as defining minimum requirements for their braking systems.

?The disaster brought to light several industry practices which have caused some concern,? Gerard McDonald, assistant deputy minister responsible for safety and security at Transport Canada, said in a conference call with reporters.

?Given that and with an abundance of precaution, we thought it would be prudent to implement these measures now.?

The disaster, which claimed dozens of lives and destroyed multiple buildings, also resulted in the release of about 5.7 million litres of oil into the air, water and soil around the small Quebec town, provincial officials estimated this week, making it one of the largest environmental disasters in North American history.

But Transport Canada officials ended the news conference when reporters started asking whether the department failed to respond to previous warnings about oversight weaknesses, raised in an audit by the federal environment watchdog in 2011 and an internal audit done five years earlier.

McDonald suggested that the 2011 audit, which recommended sweeping changes and a new risk management system in the department?s oversight of the transportation of dangerous goods, was not related to the new emergency measures unveiled Tuesday.

He was also unable to respond to revelations from internal Transport Canada documents, released to Greenpeace Canada through access to information legislation, that his department had ?identified no major safety concerns with the increased oil on rail capacity in Canada, nor with the safety of tank cars? used for transportation of dangerous goods.

Despite longstanding warnings from the Transportation Safety Board and others about the existing steel cars and other issues, Transport Canada had dismissed the rail safety concerns in a memo prepared for International Trade Minister Ed Fast in January 2013.

The assistant deputy minister suggested he was not familiar with these recommendations.

?I can?t verify what that document is, so I?m not going to speculate about it,? McDonald said.

Transport Canada announced the emergency measures as some federal MPs returned to Parliament to begin hearings, spearheaded by NDP transport critic Olivia Chow, on rail safety issues.

But MPs eventually accepted a motion from Ontario Conservative Jeff Watson, who questioned whether an immediate parliamentary study was necessary, to delay the hearings, pending further results from the ongoing Transportation Safety Board investigation in Lac-Megantic.

?This committee also should be concerned in deciding whether to commence a study now whether that draws important resources out of the field where they belong,? Watson told the House of Commons transport committee. ?That doesn?t mean there won?t be a study. The answer from this side of the table is not a ?no?, it?s a ?not yet.??

Liberal transport critic David McGuinty supported the Conservative proposal to delay the parliamentary hearings, explaining that it would allow federal officials to focus their attention on the ongoing investigation and rebuilding efforts, but he said the government also needed to provide more details about its actions and its response to the disaster.

Meanwhile, Chow suggested that the Conservatives and Liberals wanted to ?take the summer off,? adding that immediate hearings could help address longstanding safety concerns and reassure other communities fearing similar disasters in their own backyards.

?Ensure that no locomotive attached to one or more loaded tank cars transporting dangerous goods is operated with fewer than two qualified persons on a main track or sidings;

?Ensure that no locomotive attached to one or more loaded tank cars transporting dangerous goods is left unattended on a main track;

?Ensure, within five days of the issuance of the directive, that all unattended controlling locomotives on a main track and sidings are protected from unauthorized entry into the cab;

?Ensure the directional controls, commonly known as reversers, are removed from any unattended locomotives, preventing them from moving forward or backward, on a main track or sidings;

?Ensure that their company?s special instructions on hand brakes are applied to any locomotive attached to one or more cars that is left unattended for more than one hour on a main track or sidings;

?Ensure that, in addition to complying with their company?s special instructions on hand brakes referred to in the item immediately above, the automatic brake is set in full service position and the independent brake is fully applied for any locomotive attached to one or more cars that are left unattended for one hour or less on a main track or sidings.

No more mail at your door? Delivery changes eyed

WASHINGTON (AP) ? Americans for generations have come to depend on door-to-door mail delivery. It's about as American as apple pie.

But with the Postal Service facing billions of dollars in annual losses, the delivery service could be virtually phased out by 2022 under a proposal a House panel was considering Wednesday. Curbside delivery, which includes deliveries to mailboxes at the end of driveways, and cluster box delivery would replace letter carriers slipping mail into front-door boxes.

The proposal is part of broader legislation by Rep. Darrell Issa, R-Calif., chairman of the House Oversight and Government Reform Committee, designed to cut costs at the cash-strapped agency by up to $4.5 billion a year. The Postal Service had a $16 billion loss last year.

The agency has been moving toward curbside and cluster box delivery in new residential developments since the 1970s. The Postal Service in April began deciding whether to provide such delivery for people moving into newly built homes rather than letting the developers decide.

"A balanced approach to saving the Postal Service means allowing USPS to adapt to America's changing use of mail," Issa said. "Done right, these reforms can improve the customer experience through a more efficient Postal Service."

About one in three mail customers has door-to-door delivery, Issa said. The shift would include safe and secure cluster box delivery areas, he said, especially for elderly customers who receive Social Security checks and prescriptions through the mail.

About 30 million residential addresses receive delivery to boxes at the door or a mail slot. Another 87 million residential addresses receive curbside or cluster box delivery.

The cost differences are clear. Curbside delivery costs average $224 per year for each address, while cluster box delivery averages $160. Door-to-door delivery costs the agency about $350 per year, on average.

Sue Brennan, a Postal Service spokeswoman, said, "While converting delivery away from the door to curb or centralized delivery would allow the Postal Service to deliver mail to more addresses in less time, doing so is not included in our five-year plan."

Brennan said the agency's five-year plan does call for shifting 20 percent of business address deliveries from door-to-door to curbside and cluster box delivery through 2016.

Rep. Steve Lynch, D-Mass., said the plan to move some 30 million residential addresses from to-the-door to curbside and cluster box service would be virtually impossible in dense urban areas such as his hometown of South Boston crowded with triple-deckers ? three apartments stacked on top of each other.

"You'd have to knock houses down in my neighborhood to build cluster boxes," Lynch said. "This will not work."

It might work in places like Manhattan with big apartment buildings, he said.

"Look, there's no availability for cluster boxes in many communities around the country," Lynch said.

Issa's plan allows for people with physical hardships to get waivers allowing them to keep door delivery. There's also a provision giving people the option to keep door delivery by paying a special fee to cover the additional cost.

Issa's bill also allows the Postal Service to take into account factors such as poverty rates and population density in deciding which areas would be allowed to keep door delivery.

The financially beleaguered Postal Service, an independent agency, gets no tax dollars for its day-to-day operations, but is subject to congressional control.

The Postal Service is pursuing a major restructuring throughout its retail, delivery and mail processing operations. Since 2006, it has reduced annual costs by about $15 billion, cut its workforce by 193,000 or 28 percent, and consolidated more than 200 mail-processing locations.

The service's losses are largely due to a decline in mail volume and a congressional requirement that it make advance payments to cover expected health care costs for future retirees. About $11.1 billion of last year's losses were due to payments for future retiree health costs.

The volume of mail handled by the Postal Service has decreased steadily as the popularity of email, Facebook and other electronic services has grown. Total mail volume handled by the agency fell to 160 billion pieces last year from its all-time high, 213.1 billion in 2006. Revenue fell to $65.2 billion last budget year, from a high of $74.9 billion in 2008.

The Postal Service is considering several options to fix its finances, including negotiations with unions to reduce labor costs and another possible increase in prices.

The service earlier this year backpedaled on its plan to end Saturday mail delivery after running into opposition in Congress. It has tried repeatedly and unsuccessfully over the past several years to persuade Congress to approve ending Saturday mail delivery and to free the service from the advance health payments.

The Senate last year passed a bill that would have stopped the Postal Service from eliminating Saturday service for at least two years and required it to try two years of aggressive cost cutting instead. The House didn't pass a bill.

Apple Q3 2013 conference call

Apple has just announced their Q3 2013 financial results and now they're doing the conference call. There'll be a lot of boiler plate, repeated, and some interesting questions from analysts, typically answered with more boiler plate. But, there could be some sparks as well. We'll update with highlights as the come up!

  • 31.2 iPhone sold, 20% up from last year. Ahead of expectations.
  • iPhone 5 the most popular. Happy with iPhone 4S and iPhone 4 as well.
  • 51% increase in the US. Once again #1 in US smartphones. 39% share.
  • 10,000 of custom enterprise apps. American Airlines, Cisco, GE, SAP, have deployed more than 25K iPhone each. NASA, NOAA, ATF, NGIA are supporting thousands of iPhones. iOS 6 was granted validation by DoD to connect to networks.
  • 14.6 million iPads. Tough comparison. 1.9 channel inventory swing. Down 3% YoY.
  • Novartis, SAP, other have deployed over 20K iPads each.
  • 3.8 million Macs, 7% decline but higher than expectations. Global PC market declined 11%, so Mac "growing". People love the new MacBook Airs!
  • New Mac Pro still coming later this year.
  • OS X Mavericks bringing more than 200 new features. Coming in the fall.
  • State of Maine 94% selected Apple products. LA school board approved massive iPad rollout.
  • 2.4 billion for iTunes, up 29%. Both content and apps. Total 4 billion iTunes, software, services.
  • HBO Go, Watch ESPN on Apple TV. 1 billion TV episodes to date.
  • 5 year anniversary of App Store. Over 900k iPhone apps, 375k iPad apps. 11 billion to developers, 50% in the last 4 quarters.
  • 320 million iCloud, 420 million Game Center, 900 billion iMessages, 8 trillion push notifications.
  • Good Technologies says iPhone 5 most frequently activated device of any kind, iPad 83% of tablets.
  • Continuing to invest.
  • iWork for iCloud coming this fall.
  • Excited about iOS 7 coming this fall.
  • 4.1 billion Apple Retail. Strong growth in iPhone sales, MBA launch.
  • 6 new stores, 408 stores, 156 outside US. 9 new stores in September quarter, 27 new openings in fiscal 2013. 23 relocations in f2013.
  • 10.1 million average per store, down from 11 last year. 84 million visitors. 16k per store, per week.
  • 106 billion in cash offshore.
  • Retired over 4 million shares of Apple stock. 17 billion of debt issued. 2.8 billion in dividends. 16 billion cash on share repurchasing.
  • 9 million additional shares retired via open market.
  • Expectations: 34-37 billion next quarter, 36-37 gross margin.
  • Pleased with record iPhone, growth in software and services, continued popularity. Excited about OS X and iOS, new products coming fall, 2014.
  • Q&A time!!

  • Q: New products this fall, usually gross margins come down but not this time. Why?

  • Peter Oppenheimer: Largely flat, slightly down. On track for busy fall. More detail in October.
  • Q: Why channel inventory down? Balance sheet?
  • PO: More stores this year than last. Component inventory up as well.
  • Tim Cook: iPad and iPhone reduced inventory significantly. iPad down 700k, iPhone down over 600k. Typically don't like to have more inventory than they need, if can reduce, do so. Slight decrease in Mac, iPod.
  • Q: High end of smartphone market saturated, growth harder to come by? New innovations, services, reinvigorate high end of market?
  • TC: Key catalyst will always be new products and services, existing categories and new categories. Distribution opportunities, carrier relationship, expanding retail, online, and indirect channels. Also have market expansion opportunity. Already over 60% in enterprise, think there's growth opportunity. Doesn't subscribe to view higher end has hit its peak.
  • Q: iPad more of a pause ahead of refresh, broader dynamic?
  • TC: YoY 2.4 million unit decline, 80% were just due to changes in channel inventory. Reduced this year, increased last year. Overall declined by just 3%. Year ago had just announced first iPad with Retina display. Hit within mid point of their expectations for iPad sales. Not a surprise. Most recent data is iPad web share accelerated further, now 84% of web traffic from traffic. Incredible. If other tablets are selling, doesn't know what they're being used for. Incredible quarter in US education. (Repeating PO's comments from earlier.)
  • Q: Gross margin bridge? Down 150 basis points. Mix of products similar.
  • PO: Very pleased with gross margin in the quarter, high end of the range. Sequential decline not a surprise, understood effects. 1) Lower sequential revenue, lost leverage. 2) Expected a different product mix. Had some puts and takes, ultimately ended up in range.
  • Q: iPhone ASP down 5% sequentially, 10% last 2 quarters. Higher mix of 4 and 4S?
  • PO: Down 4% YoY, about $27, primarily due to mix, headwinds. iPhone 4 accelerated. Sequentially $32, mix.
  • TC: iPhone POV, moves on 4 and iPhone 5 being most popular. Very strong sales in emerging pre-paid markets. India up 400%. Very strong in US, up 50%, Japan up 60%, UK 50%. iPhone accelerated from previous. Unusual pattern for Apple. Very happy.
  • Q: China absent?
  • TC: China was weaker in quarter, although data sheet doesn't tell the complete story. Sell through with inventory changes only down 4% for year ago. HK was down more. Mainland China up 5%. Lower growth rate, attribute it to many things, including economy there. In HK, international shopping haven. More dramatic down turn there, not totally clear why. Down 20% on sell through. Weighed greater China down.
  • Q: Trade in program?
  • TC: Haven't announced anything. Rumors only. Number of channels do trade-ins now, US and different reasons. Reason is that iPhone residual value stays high, high demand, more lucrative. Win/win from many points of view. Nothing from Apple.
  • Q: Opposed to it?
  • TC: Not opposed, like environmental aspect. Encouraging.
  • Q: How do we turn China around?
  • TC: Put it into perspective. 4.9 billion. 14% of the company. Very significant. Grown significantly. Very strong market. 27 billion on trailing basis in the last year. iPad sell through was up 8%, mainland was up 37%. Share numbers for iPad over 50%. In arc of time, China huge opportunity. Don't get discouraged over 90 day cycle.
  • Q: More affordable pricing, think about growth in emergency markets, could address with more appropriate products? Both levers?
  • TC: Reference to iPhone 4. Number of 1st time smartphone buyers iPhone 4 is attracting is very impressive. Want to attract as many of those as we can. Saw that beginning to happen end of Q2. iPhone 5 most popular by far, really happy to provide high quality iPhone 4 running iOS 6 to as many first time buyers as they can. Great product for that buyer?
  • Q: More weapons you could use?
  • TC: Always more weapons, more tools in the toolbox, but great way for buyer to get in. Customer sat!
  • Q: Growth, last Q new product categories. Are there categories big enough to move the needle for Apple?
  • TC: We'll see. Working on products they're really proud of, will announce when ready.
  • Q: Russia, pricing?
  • TC: Good. If you look at Russian market, 80% of phones are sold retail, outside of carriers. Sell through a number of national chains. Activation's in Russia for iPhone set a record. Really happy. Contribution from carriers exist but much less. Not well understood. Continually looking for other relationships. Opportunity.
  • Q: Commodities? Pricing?
  • TC: DRAM pricing increased, upper pressure. NAND pricing stable, following seasonal trends. LCD prices fallen, expect further reductions. Others in balance, expect decline at historical levels.
  • Q: New products assumed shipping next quarter?
  • PO: Can't comment.
  • Q: You say better, Wall Street wants more. Does your organization limit?
  • TC: here to make great products, focus on that and financial metrics will come. Not mutually exclusive.
  • Q: Don't need to find products to get growth?
  • TC: Start at the product, most important is customer wants products. Don't start there, create things people don't want. Try hard to focus on making great products, enriching customers.
  • Q: Don't think high end is saturated, yet ASP down? Will continue to trend lower?
  • TC: Don't project ASP, give guidance that has assumption. Underneath iPhone numbers saw significant growth in iPhone 4, lower price point. iPhone 5 doing well. Allowed us to significantly beat vast majority of expectations. Sell more low end, mix changes. 3GS last year, comparable position. Selling a lot more 4 than 3GS. Understand market and distribution better. Will get better and better at that over time. How that changes mix, he doesn't know. Product has highest mix during first few months of sale. Natural seasonal decline. iPhone, iPad, on Mac. Doesn't see anything fundamentally change that.
  • Q: What are puts and takes in September quarter?
  • PO: tailwind is component costs favorable. Conversely, some effects pressure. Dollar and Yen.
  • Q: Share buyback.
  • PO: Before any further buybacks, issuances, 11 million share benefit.
  • Q: iOS in the Car?
  • TC: Very important. Part of ecosystem. Just like App Store, iTunes, content, services, messages, Siri, having something in the automobile is important. Something people want. Apple can do it in a unique way, better than anyone else, key focus.
