Baylor Health Care System Has Rescinded 69 Job Offers Made to Smokers, None ?Top-Notch Talent?

I know many of you have likely already beat me to reading the latest edition of Workforce?magazine ? the publication devoted to important trends for human resources professionals ? but I want to mention anyway that there?s a piece?that follows up on Baylor Health Care System?s?policy of not hiring anyone who uses tobacco products.

That ban went into effect in January 2012. Previously Baylor had required that employees who were smokers pay a surcharge for their health care insurance, an extra $25 a pay period. When I discussed the change with Baylor CEO Joel Allison shortly before it was made, he said ?We?re in the healthcare business, so we want people to practice good health? and noted that ??Five percent of the population uses up about 50 percent of the health care cost.?

Well, how has it worked out for Baylor? According to the article:

Anyone with a preliminary employment offer goes through drug screening, which includes nicotine screening. The test will detect any kind of nicotine product, including cigarettes, a nicotine patch, nicotine gum and e-cigarettes. So far, 69 of about 400 offers have been rescinded, she says, and there is no evidence Baylor is losing out on top-notch talent because of the screening.

Testing is possible because nicotine users are not a protected legal class in Texas. Currently 29 states and the District of Columbia offer legal protection to smokers, according to the American Lung Association.

Employees already working for the company weren?t required to quit smoking to keep their jobs, but they continue to pay the surcharge.

According to a report by the American Lung Association, employees who smoke cost employers an average of $1,429 more in health care costs than nonsmokers.

Libya to help ease Egypt crisis with $1.2 billion oil deal

TRIPOLI (Reuters) - Libya will soon start shipping oil to neighboring Egypt on soft credit terms, two senior Libyan officials said, as Cairo struggles to pay for energy imports and avoid fuel shortages.

The officials told Reuters that Tripoli would supply Cairo with $1.2 billion worth of crude at world prices but on interest free credit for a year, with the first cargo expected to arrive next month.

Egypt has slid into economic crisis since president Hosni Mubarak was overthrown two years ago. Most international companies have reduced oil product supplies to the country fearing non-payments, as the government tries to curb soaring energy subsidy costs which swallow up a fifth of its budget.

Libya plans to ship one to two cargoes a month for refining in Egypt under a deal that involves 12 million barrels of crude over 12 months, the oil industry officials said.

With foreign currency reserves running low, Egypt has not bought any crude on the open market since January. In rough terms the Libyan deal would be worth slightly more than half its 2012 imports, which the central bank put at $2 billion.

"Their situation is very bad, and if necessary they can take up to a year to pay (for each delivery)," said one of the Libyan officials.

Libyan authorities themselves face a daily struggle to keep services running and take control of a country awash with weapons looted from the arsenal of Muammar Gaddafi, who was toppled in 2011.

But the official said Libya could not shy away from helping an important trading partner. "If you are a good neighbor and something is wrong with your neighbor, you will not feel comfortable with yourself. It's human nature," he said.

Cairo has so far failed to agree a $4.8 billion loan deal with the International Monetary Fund and has sought help from energy producing countries in the region and beyond.

Tripoli has already deposited $2 billion at the Egyptian central bank and Qatar has announced $8 billion in loans, grants and other deposits since Islamist President Mohamed Mursi was elected last June.

Libya's National Oil Corporation (NOC) declined immediate comments on the details of the deal, although one of the oil industry officials said it would supply Sirteca, the cheapest of all the country's grades. "Shipments will be sold at world prices," said the second Libyan official.

An official at the Egyptian oil ministry confirmed some of the deal's terms. "(It will be) one million barrels a month and deferred payment for 12 months without interest starting from the first half of May, God willing," the official told Reuters.

However, the official maintained that the two sides were still discussing the kind of crude oil to be supplied and how long the shipments would last. The Libyan officials said that if the first cargo was sent next month as planned, they would last until April 2014.

The Libyan deal should ease the problems of Egypt, which owes at least $5 billion to oil companies, half of it overdue.

Cairo aims to raise prices of subsidized energy gradually, bringing them close to world levels in four years, to reduce the burden on its huge budget deficit. In the short term, it wants to avoid arousing more social unrest by ensuring energy supplies during the approaching summer when energy consumption peaks.

Libya has already shown willingness to step back into its old role as North Africa's version of a Gulf petro-state by using cash to open doors.

Libya's new rulers authorized a payment of almost $200 million to Mauritania after it extradited Gaddafi's former spy chief Abdullah al-Senussi last year, although they later denied there was a quid pro quo.

Diplomats and analysts have also suggested Libya's growing support may help persuade Egypt to hand over Gaddafi's cousin Ahmed Gaddaf Alddam, who was arrested in Cairo in March.

Egypt sent two other ex-Gaddafi officials to Libya last month but barred the extradition of Gaddaf Alddam, who is claiming Egyptian citizenship. Libya is appealing the Egyptian court ruling.

An Interview with Filmmaker Nathan Punwar ? The Digital Den

Nathan Punwar is an independent filmmaker based in Brooklyn, NY. He screened his last short film, ?Memory By Design,? at the New York Film Festival and Slamdance Film Festival, among others. In 2012, he edited ?Charlie Is My Darling ? Ireland 1965,? an hour-long documentary on The Rolling Stones constructed entirely from footage shot over one weekend, revealing unseen live performances and backstage antics of the band in their youth. His latest directorial project, a 25-minute narrative short film titled, ?Loves of a Cyclops,? will be playing festivals this year. SeagateCreative: Tell us about the inspiration behind the story for your new short film, ?Loves of a Cyclops??

NP: Nathan Punwar: A few years ago, I had an image in my mind of a person with a lens for an eye ? someone who saw the world through a viewfinder instead of his own eye. It was just that image. I thought I might animate it.

Over time, I started to think about what it would mean to require a device to translate the world into something that made sense, and how each animal sees the world differently. Each eye is a different lens, a different interpretation. These thoughts formed a story about a one-eyed man who can?t see the world his peers do, so he struggles to find his place in it.

SC: When you have a new, fresh idea, how do you decide if it?s worth pursuing?

NP: It?s just a matter of how persistent the idea is, how long it can stick in your head and refuse to leave. So you have no choice but to give into the idea until you get it out of your head. For me, getting it out involves walking it down every potential avenue and then backtracking to the one path that seems best to explain it to everyone else.

SC: Do you have a specific technique or ritual you use for creating?

NP: There is no technique other than to try to allow myself to be as perceptive as possible to my surroundings. This includes truly listening to people, which isn?t always as easy as it seems it should be. So there?s that, and the fine balance between it and allowing the mind to wander and float away on a tangent midday.

SC: You wrote, directed, and edited this film. Is there a particular step you find the most creative?

NP: It?s all creative and fulfilling. Writing is the most frustrating and potentially rewarding. If that goes well, and it rarely does, it makes the rest more fruitful, because you?re crafting from material that is already quality. But each part relies so precariously on the others to succeed, which is why I like doing all of it, but definitely not all at once.

SC: In terms of gear and equipment, is there a specific piece that helped you create a breakthrough in filmmaking?

NP: Simply owning a camera that we can use both casually and professionally? Even though we want to spend as much time as possible preparing to make a film as good as it can be, now we can shoot something that strikes us at any moment and repurpose it later, or play with the footage anywhere. At the very least, this means my sketchbook is no longer restricted to the page.

SC: Is there any experience you have from other art forms that play into your ability to make a film?

NP: Though I?m not a true musician, I?ve played music my whole life. I might consume more music than I do films, so a soundtrack is always on my mind. But I try other arts, even ones I?m bad at, because good films involve photography, performance, writing, design, music, fashion, architecture, lighting, and more. If one falters, so does the end result.

A film may not be pure in the same way other arts are, but it has the ability tie them together to convey something in a way that none can on their own, which is why I want to understand and answer to each and every aspect individually.

SC: How did you work on the music for this film, then?

NP: Our composer is Mike Schanzlin, and I would say he and I are on a similar wavelength with music. We make mixes together, and talk about collaborating on ideas often, even though he really knows how to record and play, and I don?t. So he turns my abstract descriptors into musical themes with his studio magic. There was one song I really wanted to include, though, outside of our original score. It?s an early demo recording by Real Estate, and the guys in the band were very cool about letting us use it in the film.

SC: Where there any significant obstacles you encountered while trying to make this film?

NP: Our greatest obstacles were really self-imposed. We decided upon three things from the beginning. The first was that we would primarily cast non-professional actors, mostly friends. The second was that we would make the film with equipment we owned or had access to, with no real budget other than what I could afford to spend out of my own pocket. The third was that we would schedule around everyone?s day jobs. For these reasons and more, it took us about a year to finish a 25-minute film. But these limitations also led us to have some of the most fun and strange experiences on our shoots, the kind you can?t have on a set where significant money is being spent every minute.

SC: What?s one piece of advice you?d give an aspiring filmmaker to help them develop their ideas?

NP: I?m still aspiring, too, so I guess my advice to myself is to take a different route each time. Whoever didn?t get the last thing might get the next thing. Even if I?m still exploring the same ideas that interest me most, at least it?ll be in new and different ways, allowing the work to discover more deeply, or at least find its way to new audiences.

SC: Where is ?Loves of a Cyclops? screening and what?s next from you that we can look forward to?

NP: ?Loves of a Cyclops? will be screening at festivals this year, with additional screenings in New York City. My partner Kathleen Kyllo (who produced and stars in Loves of a Cyclops) and I are attempting our first feature script together, or some kind of series, or whatever it turns into. At some point, we?ll have to figure out a way to finance these things, but for now, we?re just focused on trying to write something true and good.

Today Marks Virgin Galactic's First Rocket-Powered Test Flight

Earlier this month, Virgin Chairman Richard Branson announced at the launch of Virgin America's new route through Newark that his other flying endeavor would be hitting a huge milestone this month: Its first rocket-powered test flight.

From the looks of Virgin Galactic and Branson's Twitter feeds this morning, it looks like that time has come.

In late February, Virgin successfully tested the very rocket that would power its first rocket-powered test flight.

While neither account has specified that this test is, in fact, of the rocket-powered variety, Galactic PR did confirm to me earlier this month that the test would take place before the end of the month and, well, it's the end of the month. Not to mention all the buzz on Twitter from various Virgin groups and notable individuals, I think it's safe to say that this is the day the whole team at Galactic and space traveling enthusiasts have been looking forward to for some time.

Looks like SS2 has been released but still no mention of a rocket being fired.

Well, this is rather interesting. Today's test touched on many a milestone for Virgin Galactic, but I didn't know that a commercial vehicle had never broken Mach 1.

As it turns out, Galactic is not, in fact, the first commercial vehicle to break Mach 1, it's just the first commercial spaceship to do so.

This morning's test took off at 7:02AM local time in the Mojave. Branson had this to say via a press release:

?The first powered flight of Virgin Spaceship Enterprise was without any doubt, our single most important flight test to date,? said Virgin Galactic Founder Sir Richard Branson, who was on the ground in Mojave to witness the occasion. ?For the first time, we were able to prove the key components of the system, fully integrated and in flight. Today?s supersonic success opens the way for a rapid expansion of the spaceship?s powered flight envelope, with a very realistic goal of full space flight by the year?s end. We saw history in the making today and I couldn?t be more proud of everyone involved.?

According to the release, SS2 was released from WK2 45 minutes into the flight at about 47,000 feet. Once all systems were go, aviator Mark Stucky and his co-pilot Mike Alsbury flipped the switch for a 16 second burn that took SS2 up to 55,000 feet. In the process, SS2 reached Mach 1.2 going supersonic.

?The rocket motor ignition went as planned, with the expected burn duration, good engine performance and solid vehicle handling qualities throughout,? said Virgin Galactic President & CEO George Whitesides. ?The successful outcome of this test marks a pivotal point for our program. We will now embark on a handful of similar powered flight tests, and then make our first test flight to space.?

Virgin is expected to make its first full space flight before the end of the year.

Police arrest Tupelo, Miss., man in ricin case

The FBI arrested Tupelo, Miss., resident Everett Dutschke in connection to the ricin-laced letters sent to President Obama and two other officials, police said Saturday. NBC News' Kristen Welker reports.

A Tupelo, Miss. man has been arrested and charged in connection with the letters addressed to President Obama and a U.S. senator that initially tested positive for the poison ricin, police said Saturday.

James Everett Dutschke, 41, was charged with possessing and attempting to use ricin as a biological weapon, the Department of Justice announced. Dutschke could face life imprisonment and a $250,000 fine if convicted.

He was arrested in the pre-dawn hours of Saturday morning by federal agents. Investigators searched Dutschke?s home on Tuesday in the expanding case into the letters sent to the president, U.S. Senator Roger Wicker and Lee County, Miss., Justice Court Judge Sadie Holland.

The arrest took place at Everett?s home in Tupelo without incident, an FBI spokesperson said.

The possibility that Dutschke might be of interest to investigators was raised earlier in the week by an attorney representing another Mississippi resident, Paul Kevin Curtis, who was arrested on April 18. Charges against Curtis were dropped on Tuesday.

?I respect President Obama and love my country,? Curtis said at a news conference on Tuesday. ?I would never do anything to pose a threat to him or any other U.S. official.?

As Dutschke?s home was searched on Tuesday, he told reporters that he had nothing to do with the case.

?I guess Kevin got desperate,? Dutschke told the Jackson Clarion Ledger. ?I feel like he?s getting away with the perfect crime.?

?I don?t know anything about this. Where are the allegations coming from? Who made the allegations? The defense attorney for the accused,? Dutschke said.

Curtis, 45, a professional Elvis impersonator, was the first man arrested in the case. Wicker said that he recognized the man after his arrest, and had once hired the man he called ?very entertaining? to perform as Elvis at a party.

The letters sent to Obama and Wicker were both postmarked April 8, 2013, and mailed out of Memphis, Tenn. They end with an identical phrase, according to an FBI bulletin obtained by NBC News: ?to see a wrong and not expose it, is to become a silent partner to its continuance.?

The letters also ended with the message, ?I am KC and I approve this message.?

An FBI agent testified on Monday that a search of Curtis? home and vehicle did not turn up any ricin or castor beans, which are used to make the poison.

?There was no apparent ricin, castor beans, or any material there that could be used for the manufacturing, like a blender or something,? Agent Brandon Grant said in a courtroom in Oxford, Miss., according to the Associated Press.

"This enzyme, when it's elevated it results in conversion and creation of more toxic species," Dr. Christopher ?Chitambar explained. ?An oncologist with Froedtert and The Medical College of Wisconsin he hopes this knowledge will lead to one more way women can protect themselves. "Everybody wants to see what they can do with their lifestyle to reduce their risk of cancer."

Kim hopes other women are listening to their doctors and the new research. "I don't want anyone to go through what I've gone through. ?So if you you can reduce your odds, just put that other glass to the side."

Not every woman's body produces a higher level of this enzyme. The hope down the road it to develop a test to identify the women who do. ?Doctor's can then let them know they might be at a greater risk if they choose to drink.

Weight loss programs via virtual reality

Apr. 25, 2013 ? Weight loss is a topic of concern for nearly 36% of Americans who are considered obese. There are many barriers that can interfere with weight loss. For those attending face-to-face weight loss programs, barriers can include travel, conflict with work and home, need for childcare, and loss of anonymity.

In a new study released in the May/June 2013 issue of the Journal of Nutrition Education and Behavior, investigators from The University of Kansas Medical Center continue to explore alternative weight management delivery methods to eliminate some of these barriers. The solution they are investigating -- virtual reality for weight loss and weight maintenance.

Looking at the results from twenty overweight and obese individuals after 3 months of a weight loss program at a weekly clinic delivered via face-to-face or virtual reality and then 6 months of weight maintenance delivered via virtual reality, the investigators found virtual reality compares favorably with face-to-face for weight loss and may facilitate greater weight maintenance. Debra Sullivan, lead investigator, adds, "Although we found weight loss was significantly greater for face-to-face compared to virtual reality, weight maintenance was significantly better for virtual reality."

The virtual reality weight maintenance program was conducted using Second Life, a Web-based virtual reality environment available to the public. Participants in Second Life create virtual representations of themselves, called ''avatars,'' which can interact with other avatars and navigate through the virtual world of Second Life. Voice communication is accomplished via headset, which allows for person-to-person and group interaction. Education and training takes place on an ''island,'' which is purchased from Second Life and provides restricted group access to the nutrition education/training area.

To further explain how Second Life can be used in this capacity, Dr. Sullivan explains, "Individuals who want to participate in real-life scenarios without real-life repercussions can use virtual reality. For example, participants can practice meal planning, grocery shopping, and dietary control when eating at restaurants and holiday parties to a much greater extent with Second Life compared with the time-limited clinic meeting. Virtual reality may even be able to serve as a more feasible option to monitor individuals after completing a weight loss program."

Effingham Health System receives breast cancer grant - Savannah ...

The Coastal Georgia Affiliate of Susan G. Komen for the Cure recently awarded a record-breaking total of $345,000 for community services that will fund everything from educational programs to screening mammograms. This brings the total investment in the local community to over $1.3 million dollars since the Affiliate?s inception.

Susan G. Komen for the Cure has awarded eight grants to programs providing breast cancer services in the Coastal Georgia area. One of the recipients is Effingham Health System, receiving funding for a breast health education and screening program. ?Through our grants program, we are able to provide life-saving services to Coastal Georgia residents that might otherwise fall through the cracks,? said Beth Desloges, executive director of the Coastal Georgia Affiliate. ?This year we focused our funding on increasing access to care for underinsured women, particularly rural, African American and Latina populations.?

Effingham Health System will be hosting six breast health education forums at area churches over the next six months, and women in attendance will have an opportunity to receive a free clinical breast exam in addition to information on self exams and risk factors. Education will be offered in both English and Spanish as needed, and an interpreter will be on hand to assist with questions and family history collection.

?Our mission is to reduce the undetected breast cancers that threaten the women of our community,? said Melissa Waller, Community outreach coordinator at Effingham Health System. ?There are women out there who have never had an exam, much less a mammogram. We want to be sure that these women get information, and the needed services, regardless of their uninsured status.?

Grant funding is generated through a number of Affiliate fundraisers held throughout the year, the largest of which is the Susan G. Komen Race for the Cure which was scheduled for April 13.

Suspected child kidnapper-rapist arrested in Mexico

LOS ANGELES (Reuters) - A convicted felon suspected in the kidnapping and rape of a 10- year-old California girl who was snatched from her bedroom last month was arrested early on Wednesday in Mexico and returned to Los Angeles, FBI officials said.

Tobias Dustin Summers, also a reputed member of a white supremacist street gang in the San Fernando Valley area of Los Angeles, was wanted on 37 criminal counts stemming from the March 27 kidnapping, the FBI said.

The girl was abducted from her home in the middle of the night, driven to various locations in two vehicles and raped before being dropped off near a hospital, according to police.

A passerby who saw her wandering barefoot with cuts and bruises outside a coffee shop watched over her until police were summoned.

Authorities did not provide details of the location and circumstances of Summers' capture, but FBI spokeswoman Lourdes Arocho in Los Angeles confirmed he had been taken into custody in Baja California by Mexican national police.

At an afternoon news conference, Los Angeles Police Chief Charlie Beck credited a $50,000 reward that was "highly publicized south of the border" with leading to a telephone tip that helped authorities pinpoint Summers' whereabouts.

The fugitive's identity was initially confirmed by his tattoos, which the FBI said included the Superman logo on his upper chest, police said.

FBI special agent Tim Delaney, who oversees the criminal division of the FBI field office in Los Angeles, said Summers was returned to Los Angeles after his arrest. Beck said he would be held in lieu of $19 million bond.

Police and the FBI declined to comment on media reports that the suspect was found at a Mexican drug rehabilitation center south of Tijuana. Beck had said about three weeks ago that Summers was seen in surveillance video images crossing a foot bridge into Mexico.

Summers, 32, was indicted earlier this month on one count each of kidnapping a minor, kidnapping to commit another crime and first-degree burglary, plus 34 counts of various sex offenses. He faces multiple life prison terms if convicted, according to the District Attorney's Office.

His accused accomplice, 29-year-old Daniel Martinez, who was charged with one count each of kidnapping and burglary, was arrested on March 31.

Police have said Summers has a lengthy criminal history and had served prison terms for robbery, kidnapping, explosives possession and theft. He was most recently released from state custody in July 2012 under a program designed to ease prison overcrowding in California.

Suspect in Canada terror plot rambles in cout appearance

TORONTO (AP) ? A man accused of plotting with al-Qaida members in Iran to derail a train in Canada gave a rambling statement in a Toronto court Wednesday and appeared to be saying he does not recognize its jurisdiction.

Law enforcement officials in the U.S. said the target was a train that runs between New York City and Canada. Canadian investigators say Chiheb Esseghaier, 30, and Raed Jaser, 35, received guidance from members of al-Qaida in Iran. Iranian government officials have said the government had nothing to do with the plot.

"My comment is the following because all of those conclusions were taken out based on criminal code and all of us know that this criminal code is not a holy book," Esseghaier said at the hearing Wednesday. "We cannot rely on the conclusions taken out from these judgments."

The judge told him to "save that for another court," and take the advice of his lawyers. He was given a May 23 court date.

Charges against the two men in Canada include conspiring to carry out an attack and murder people in association with a terrorist group. Police ? tipped off by an imam worried by the behavior of one of the suspects ? said it was the first known attack planned by al-Qaida in Canada. The two could be sentenced to life in prison if convicted.

In a brief court appearance in Montreal on Tuesday, Esseghaier declined to be represented by a court-appointed lawyer. He made a brief statement in French in which he rejected the allegations against him.

Esseghaier, who was arrested Monday afternoon at a McDonald's restaurant in the train station, was later flown to Toronto for Wednesday's appearance in the city where his trial will take place.

Jaser also appeared in court Tuesday in Toronto and also did not enter a plea. He was given a new court date of May 23. The court granted a request by his lawyer, John Norris, for a publication ban on future evidence and testimony.

The case has raised questions about the extent of Shiite-led Iran's relationship with al-Qaida, a predominantly Sunni Arab terrorist network. It also renewed attention on Iran's complicated history with the terror group, which ranges from outright hostility to alliances of convenience and even overtures by Tehran to assist Washington after the Sept. 11, 2001, attacks on the United States.

Law officials in New York with knowledge of the investigation told The Associated Press the attack was to take place on the Canadian side of the border. They are not authorized to discuss the investigation and spoke only on condition of anonymity.

Jaser's lawyer said on Tuesday that his client questioned the timing of the arrests, pointing to ongoing debates in the Canadian Parliament over a new anti-terrorism law that would expand the powers of police and intelligence agencies.

Norris speaking outside the court said his client is "in a state of shock and disbelief."

He said his client would "defend himself vigorously" against the accusations, and noted Jaser was a permanent resident of Canada who has lived there for 20 years. Norris refused to say where Jaser was from, saying that revealing his nationality in the current climate amounted to demonizing him.

Canadian police have declined to release the men's nationalities, saying only they had been in Canada a "significant amount of time." But a London-based newspaper Al Arab reported Wednesday, citing unnamed sources in the Gulf, that Jaser is a Jordanian passport holder with full name Raed Jaser Ibrahim Amouri, who had visited the UAE several times and most recently in September 2011. The newspaper reported that the suspect also visited other Gulf countries including Qatar and Saudi Arabia. It was not possible to independently confirm the report.

Esseghaier's, in a profile on a university department website ? which has since been removed ? says he was born in Tunis, Tunisia.

Muhammad Robert Heft, president of the P4E Support Group Inc., a non-profit organization that provides support to Muslims in Canada, said Jaser's father Mohammad Jaser came to him several times citing concerns about the radicalization of his son. The discussions took place between 2010 and 2011, while the father was living in a basement apartment in Heft's home in Markham, Ontario. The pair took up accommodation there while awaiting surgery for Jaser's younger brother, who had been in a serious car accident, because the apartment didn't have stairs.

"He came to me about his son saying he how concerned he was getting about the rigidness of his son and his interpretation of Islam. He was becoming self-righteous, becoming pushy, pushing his views on how much they (his family) should be practicing as a Muslim," said Heft.

"His son was becoming overzealous and intolerant in his understanding of the religion," he said. "Those are the telltale signs that can lead into the radicalization process."

The investigation surrounding the planned attack was part of a cross-border operation involving Canadian law enforcement agencies, the FBI and the U.S. Department of Homeland Security. Canadian police said the men never got close to carrying out the attack.

The warning first came from an imam in Toronto, who in turn was tipped off by suspicious behavior on the part of one of the suspect.

Varian Medical slips on weaker 2Q oncology orders

NEW YORK (AP) -- Varian Medical Systems Inc.'s profit rose in its most recent quarter, but orders for cancer treatment systems fell on weaker demand in North American and Europe.

The company's outlook for the current quarter fell short of Wall Street predictions, and it trimmed its sales guidance slightly for the year. Shares dropped $3.35, or 4.9 percent, to $65 in aftermarket trading.

The Palo Alto, Calif., company said its net income in its fiscal second quarter rose 5 percent, to $112.8 million, or $1.02 per share. Restructuring charges cost the company 2 cents per share. In the January-March period a year ago, Varian reported a profit of $107.8 million, or 94 cents per share.

Revenue rose 7 percent, to $768.4 million from $720.3 million.

Analysts were forecasting net income of $1.02 per share on $758.1 million in revenue, according to FactSet.

While revenue from oncology system sales rose 3 percent to $581.8 million, orders dropped 2 percent to $555 million. A decline of 9 percent in North America canceled out growth in emerging markets overseas.

Revenue for the company's X-ray division rose 14 percent to $140.4 million, helped by demand for new products.

For the current quarter, Varian expects per-share profit of 98 cents to $1.02 and that revenue will rise 7 percent, to about $755 million. Analysts expect profit of $1.05 per share and revenue of $766.8 million.

Varian is also slightly less optimistic on revenue growth for the year, now predicting a gain of 8 percent rather than 8 to 9 percent. That suggests revenue of $3.03 billion ? analysts expect $3.04 billion.

The company tightened its profit prediction for the year to $4.09 to $4.14 per share from $4.08 to $4.16 per share.

Shares slipped 16 cents to close at $68.35 Wednesday before results were released.

James Buchanan: Why is he considered America?s worst president?

April 23 marks the birthday of James Buchanan, the man regarded by many historians as one of the worst?if not the worst?presidents of all time. So what did Buchanan do to earn the disrespect of so many people?

Today, most people know Buchanan for three things: He was single for his entire presidency; he?s the only president from Pennsylvania; and he was the president before Abraham Lincoln.

It?s that final point that has been the lasting part of the Buchanan presidency, with his apparent indifference to the onset of the Civil War, that has riled up so many academics.

Of course, Lincoln was a hard act to precede or follow: Lincoln?s successor Andrew Johnson is usually cast as Buchanan?s biggest rival for the title of worst president (along with the scandal-plagued Warren Harding from the early 1920s).

Buchanan came to the presidency under somewhat traditional but trying circumstances.

He was a five-time member of the House of Representatives, the secretary of state under President James Polk, and the U.S. minister to Great Britain.

At the Democratic convention in Cincinnati in 1856, Buchanan took the lead from the incumbent president, Franklin Pierce, on the first ballot and then battled Senator Stephen Douglas from Illinois for the presidential nomination.

Buchanan won on the 17th ballot and defeated John C. Fremont, of the newly formed Republican Party, in the 1856 presidential election.

It was all downhill from there for President Buchanan.

Buchanan became severely ill and almost died from an illness that was spread throughout his hotel in Washington, where he traveled for meetings as president-elect.

In his inaugural address, Buchanan called the territorial issue of slavery ?happily, a matter of but little practical importance.? He had been tipped off about the Supreme Court?s decision in the Dred Scott v. Sandford case, which came shortly after the inauguration. Buchanan supported the theory that states and territories have a right to determine if they would allow slavery. (There were also reports Buchanan may have influenced the court?s ruling.) The Dred Scott decision angered and solidified Buchanan?s Republican opponents, and it drove a wedge into the Democratic Party. The country also went into an economic recession as the Civil War approached.

By 1860, it was apparent that Buchanan wasn?t going to be a candidate for re-election. At the Democratic convention, he managed to derail Douglas? campaign to be the sole nominee who would take on Abraham Lincoln. (Douglas defeated Lincoln in the 1858 senate election in Illinois.)

The Democrats were left with two presidential nominees (Douglas and John Breckinridge), which almost ensured Lincoln?s election.

Within three months after the election, seven states had left the Union as Buchanan remained as a lame-duck president until Lincoln could take office in March 1861.

In his State of the Union message to Congress, Buchanan said he believed the South?s secession wasn?t legal, but the federal government didn?t have the power to stop it.

?All for which the slave States have ever contended, is to be let alone and permitted to manage their domestic institutions in their own way. As sovereign States, they, and they alone, are responsible before God and the world for the slavery existing among them. For this the people of the North are not more responsible and have no more fight to interfere than with similar institutions in Russia or in Brazil,? Buchanan said.

Buchanan also explained why he wasn?t actively involved in the secession battle as president.

?It is beyond the power of any president, no matter what may be his own political proclivities, to restore peace and harmony among the states. Wisely limited and restrained as is his power under our Constitution and laws, he alone can accomplish but little for good or for evil on such a momentous question.?

Buchanan did little else during the crisis. Part of his Cabinet resigned. And although he wouldn?t give up Fort Sumter, his inaction gave the new Confederacy time to organize.

He rode to Lincoln?s inauguration with the new president, and reportedly told Lincoln, ?If you are as happy entering the presidency as I am leaving it, then you are a very happy man.?

Buchanan had other issues during his presidency, including an obsession with Cuba and a controversy involving a war with Mormon settlers in the Utah territory.

The New York Times? Nate Silver said earlier this year that based on composite rankings from four recent surveys, Buchanan was the lowest-ranked president among those polled.

In fact, Buchanan has been ranked among the three worst presidents in every poll and survey conducted since 1948 and in the past decade, and replaced Harding as the usual last-place finisher in these studies.

Buchanan retired to his estate in central Pennsylvania and lived to see the end of the Civil War. Just before his death in 1868, he said, ?History will vindicate my memory from every unjust aspersion.?

Immigration bill could fix some Boston security issues: official

WASHINGTON (Reuters) - A top Obama administration official said on Tuesday that an immigration bill starting to move through Congress would fix some border control weaknesses that may have contributed to last week's Boston Marathon bombings.

The immigration to the United States of two ethnic Chechen brothers who are suspects in the bombings has become a point of controversy in the early debate over the legislation, with some conservatives saying that Congress should now go slower.

Homeland Security Secretary Janet Napolitano repeatedly was asked at a Senate Judiciary Committee hearing about the Boston violence that killed three and injured more than 250, as the panel was wrapping up its hearings on a comprehensive immigration bill.

Napolitano told the panel that the legislation will "strengthen security at our borders."

But in three hearings held by the committee since the Boston bombings, some Republicans have raised new concerns about the legislation.

"If these two individuals used our immigration system to assist their attacks, it's important to our ongoing discussion," said Senator Charles Grassley, the senior Republican on the panel.

One of the two suspects, Tamerlan Tsarnaev, who was killed last week after a gunfight with police, traveled from the U.S. to Russia in 2012, returning six months later. He and his brother both came to the United States legally a decade ago.

Officials have said that a misspelling of Tsarnaev's name on flight records when departing the United States last year may have contributed to some law enforcement agencies not being alerted to his movements.

CALMING NEW ANXIETIES

"The bill will help with this because it requires that passports be electronically readable as opposed to having manual input," Napolitano testified, adding the legislation "really does a good job of getting human error out of the process."

The bill's supporters also have tried to calm new anxieties over the legislation, arguing that by moving approximately 11 million illegal residents onto a path to citizenship - if they meet certain requirements - law enforcement will be able to learn more about those undocumented people.

"The bipartisan immigration reform proposal introduced last week would enable us to identify and perform criminal background and national security checks on immigrants who are here unlawfully," Senate Majority Leader Harry Reid said in a letter to Republican Senator Rand Paul of Kentucky.

Paul, who earlier this year expressed support for comprehensive immigration legislation, said on Monday that Congress "should not proceed" until more is known about failures in the immigration system related to the Boston bombing.

The Senate Judiciary Committee plans to spend the month of May debating and voting on panel members' amendments to the immigration bill introduced last week by four Democratic and four Republican senators.

Reid hopes to have the legislation, a top priority of President Barack Obama, ready for a long debate by the full Senate in June.

During Tuesday's Senate hearing, Napolitano heard criticisms from both Democrats and Republicans about specific aspects of the immigration bill that will take center stage in coming weeks.

"I question whether spending billions more on a fence between the United States and Mexico is really the best use of taxpayer dollars as we're furloughing air traffic controllers," said Senator Patrick Leahy, the Democratic chairman of the Judiciary Committee.

Republican Senator John Cornyn of Texas questioned whether the bill's emphasis on tightening border security at major "hot spots" in Arizona and Texas would merely encourage drug cartels and other criminals to shift their activities to border crossings that are monitored less.
