Protecting Tenants from Foreclosure | The Niche Report

(TheNicheReport.com) ? With the collapse of the real estate market and the resulting bank foreclosures on hundreds of thousands of residential rental properties, often tenants residing as leaseholders in residential properties become collateral victims and are forced to vacate their leaseholds, often with minimal notice. As a result, one of the most frequently asked questions posed to real estate lawyers today is, ?What are the rights of a tenant when the property they are occupying has been foreclosed by the bank??

In response to this problem, the Obama Administration enacted and approved a bill in May of 2009, known as the Protecting Tenants at Foreclosure Act of 2009, as part of Title VII of the Helping Families Save Their Homes Act of 2009 and codified at 12 U.S.C. 5220.? Enacted during a period when unprecedented numbers of foreclosures were occurring across the country, the Act ensures that tenants receive appropriate notice of foreclosure and are not abruptly displaced.

Under the Act, a lender or other immediate successor-in-interest, generally the purchaser who acquires residential real property by virtue of a foreclosure sale on a federally related mortgage loan, must provide bona fide tenants residing in the property with notice to vacate of at least 90 days. 12 U.S.C. 5220 (a)(1)

Moreover, if the tenant in possession has in effect a valid and existing bona fide lease, the purchaser at the foreclosure sale takes the residential real property subject to any remaining term of the lease.

These provisions, however, do not apply where the purchaser at the foreclosure sale is not the bank or an investor but a purchaser who intends to occupy the property as a primary residence.

Additionally, to fall within the Act, a bona fide lease must be entered into prior to the date of the notice of foreclosure, which is defined as ?the date on which complete title to a property has been transferred to a successor entity or person as a result of an order of a court or pursuant to the provisions in a mortgage, deed of trust, or security deed.?

A bona fide lease is one in which: (1) The mortgagor or the child, spouse, or parent of the mortgagor under the contract is not the tenant; (2) the lease or tenancy was the result of an
arm?s-length transaction; and (3) the lease or tenancy requires the receipt of rent that is not substantially less than fair market rent for the property. 12 U.S.C. 5220 (a)(2)

The protections provided by the Act will be in place till December 31, 2014, when they are set to expire.

For local coffee shops, it?s all about being green / By Nicole Carbon

In honor of Earth Day on April 22, and in my ever-increasing effort to be more ?green,? I took a deeper look at where I choose to get my coffee, my second drink of choice after cocktails. I learned that fair-trade coffee not only promotes superlative labor standards, but it is also good for the environment. Any product labeled ?fair trade? must meet a set of standards determined by the Fair-trade Labeling Organizations International. This organization ensures that pesticides are banned, minimal water is used for irrigation and organic waste is disposed of sustainably. Here?s a list of some of my favorite fair-trade Austin coffee houses.

CAFF? MEDICI

Caff? Medici may just be serving the very best coffee in Austin. It was started in 2006 by Michael Vaclav and his wife, Alison. The original location is on West Lynn Street in the quaint Clarksville neighborhood. Two years later, they opened a second location across from campus on Guadalupe. Their third and newest location opened last year at the base of the posh Austonian condominium tower. Caff? Medici?s mission is to provide exceptional customer service (which they do) and to continue to learn and educate about the highest-quality coffee-making practices possible. The quaint coffeehouse in Clarksville is one of my favorite escapes, and I have also had some great dates there, sitting outside watching the neighborhood dwellers pass by. The newer location has more of a loft-like feel and provides the perfect perch for a quick shot of espresso to keep up with the hustle and bustle of downtown. Caff? RUTA MAYA

I have known about Ruta Maya for years and have wanted to go there for the complimentary yoga classes offered Monday through Saturday. For some reason, I hadn?t made the trek far enough down South Congress Avenue to stop in for a class and some coffee. It was when I visited the Hops & Grain Brewery and learned about their newest brew, Ruta Maya Dark, made with cold-brewed Ruta Maya Coffee, that I knew I had to taste the coffee on its own. We walked into the vast space with tables and chairs scattered about. In all honesty, the interior looked more like a dance hall than a coffeehouse, but I wasn?t complaining, especially once the double espresso hit my lips. One sip and I was hooked. We decided on a pound of the dark roast to go. The burlap sack it is packaged in now replaces my beloved PLU 323, aka extra dark French roast from Whole Foods Market. In order to avoid bankruptcy debtors should investigate all available debt relief options. The Internet can be a good tool to locate personal finance information. However, consumers must use caution before spending their hard earned cash on advertised products or services which claim to reduce debts.

The easiest way to avoid bankruptcy is to develop a household budget and commit to sticking to it, no matter what. People are often unaware of how much money is wasted on unnecessary items. Irresponsible spending habits quickly exhaust bank accounts; leaving debtors with less money than month.

One of the biggest mistakes consumers can make is to use credit cards for daily expenses. Charging a daily cup of coffee and fast food lunch can add up to hundreds of dollars in interest which in turn creates additional debt. Debtors cheat themselves of their own money when they do not pay monthly credit card bills in full.

Debtors may be able to prevent bankruptcy by becoming aware of where they spend money. The simplest way to determine where the money goes is by tracking every expense. Most people are surprised to discover how much money is spent on items they don't really need.

Many people believe filing personal bankruptcy will free them from debt bondage. However, the cost of filing bankruptcy hits more than the wallet. In addition to court filing fees and legal expenses, debtors must repay a portion of debts by establishing a Chapter 13 payment plan.

Additionally, new bankruptcy laws enacted in 2005 require bankruptcy petitioners to obtain professional credit counseling. Debtors must abide by guidelines set forth in the Bankruptcy Abuse Prevention and Consumer Protection Act (BAPCPA) or run the risk of having their petition dismissed.

Credit counseling must be conducted by an agency approved by the U.S. Trustee. Once counseling is completed, debtors submit a certificate of completion through the court. Debtors are allowed to obtain credit counseling up to six months prior to submitting their bankruptcy petition.

Credit counseling can sometimes help debtors avoid bankruptcy altogether. Credit counselors review debtors' income, expenses, and spending habits to determine which debt relief options are best suited. In some cases, credit counselors can negotiate with creditors to reduce outstanding balances, lower interest rates, and eliminate late fees and penalties.

Debt consolidation might be a viable option for debtors who own real estate with accrued equity. Homeowners take out a home equity loan using real estate as collateral. Funds are used to pay off high interest loans and credit card debts.

Interest rates assessed on real estate loans are significantly less than interest rates assessed for unsecured loans and credit card companies. Transferring debts to low-interest loans can save borrowers hundreds, if not thousands, in interest charges alone. However, using real estate to secure loans can be risky. If borrowers default on home equity loans they could potentially lose their property to foreclosure.

As the cost of living continues to rise, consumers must become proactive and pay attention to their spending habits. Several options are available for reducing monthly expenses. Common ways to reduce expenses include: enrolling in utility budget plans; reducing cell phone plans; bundling services such as cable, Internet, and home phone; and using grocery coupons and manufacturer rebates.

If filing personal bankruptcy is the only viable option, debtors should take time to become educated about the process and comparison shop bankruptcy lawyers. It is important to understand that bankruptcy remains on credit reports for 7 years and can prevent consumers from obtaining credit of any kind for two or more years.

United South End Settlement Announcese ?Compositions: Art ...

BOSTON -The walls of United South End Settlements? (USES) Harriet Tubman House dance with the whimsical rhyme and repetition of artwork hung in harmony. Compositions: Art Inspired by Music, an exhibition featuring work from local Boston artists, is currently on display through April 5, 2012.

A closing reception will be hosted on Thursday April 5, 2012, from 6 ? 8 pm at 566 Columbus Avenue in Boston?s South End. Free, light refreshments will be available as well as musical performances by students from the Boston Conservatory.

USES, a nonprofit organization, is located in the South End neighborhood of Boston and works to build strong community by improving the education, health, safety, and economic security of low-income individuals and families in Boston?s historic South End/Lower Roxbury, serving as a national model of neighborhood engagement that builds successful lives and strong community.

?This artwork is really meant to move you,? says Chelsea Revelle, Director of Arts & Culture at USES. ?These pieces really epitomize the raw energy, emotion, and imagination that music brings to our lives.?

Among the artwork displayed, the most striking might be a large string installation by Jessica Ginsberg. Mimicking cords of a cello or a scale that balances musical notes, your eyes will easily traverse the architecture, enticing your body to follow suit as you move to view the piece from multiple perspectives. Other artists, like Carolyn Newberger, capture the influence of music not only through watercolors, but also as in musical performances with the Principal Tuba of the Boston Symphony in the Cupcake Philharmonic Orchestra, a sextet under the aegis of the community outreach program of the Boston Symphony Orchestra.

The Compositions art exhibit will run from through Thursday, April 5. The exhibit, which is free and open to the public, runs Mondays through Fridays, 8 am ? 8 pm. The exhibit is showcased at the Harriet Tubman Gallery, located at 566 Columbus Avenue in Boston?s South End. The building is wheelchair accessible. Street parking is limited, and viewers are encouraged to take public transportation, via the Massachusetts Avenue Orange Line stop or the #1 and #43 buses.

Yolanda Hadid Joins The Real Housewives of Beverly Hills

Yolanda Hadid is the latest member of the Real Housewives of Beverly Hills. The rumors are true, Camille Grammer will not be returning. I cant say I am surprised, she was extremely boring to watch this season. Yawn fest. Camille has finally confirmed that she will not return for season 3, but denied speculation that it was because she didn’t want to “expose her personal life anymore”. “I can’t say too much at this moment, but we couldn’t get it worked out. In an interview with him we discussed general aspects relevant to the VI Student/Professional Conference the organization will be holding at Cornell University next month.

1. What makes this year?s conference at Cornell so special?

4. What is a good example of an impact created by a PC conference? Does it go beyond being an informational forum? What usually happens after the conference is over?

The conference serves several?purposes: Strengthen our growing organization and networking, create a forum for?thoughtful?discussion?and debate, and cement our foundations to keep attracting the best talent from universities across the U.S. and Canada. Once the conference is over, we use these connections to keep growing and create a sense of community. The event also shows potential recruiters, the quality of the people in PorColombia and generates many job opportunities. Camille Grammer will not return to The Real Housewives of Beverly Hills for season three. But was this departure really a mutual decision reached by the reality star and Bravo producers? It doesn't sound that way.

Asked about the exit at the opening of a new Blizz Frozen Yogurt at the MGM Grand in Las Vegas on Saturday night, Camille told Us Weekly:

"I've had so much fun with the franchise, but I guess the producers and I couldn't come to an agreement."

Studies: Surgery can put diabetes into remission

CHICAGO (AP) ? New research gives clear proof that weight-loss surgery can reverse and possibly cure diabetes, and doctors say the operation should be offered sooner to more people with the disease ? not just as a last resort.

The two studies, released on Monday, are the first to compare stomach-reducing operations to medicines alone for "diabesity" ? Type 2 diabetes brought on by obesity. Millions of Americans have this and can't make enough insulin or use what they do make to process sugar from food.

Both studies found that surgery helped far more patients achieve normal blood-sugar levels than medicines alone did.

The results were dramatic: Some people were able to stop taking insulin as soon as three days after their operations. Cholesterol and other heart risk factors also greatly improved.

Doctors don't like to say "cure" because they can't promise a disease will never come back. But in one study, most surgery patients were able to stop all diabetes drugs and have their disease stay in remission for at least two years. None of those treated with medicines alone could do that.

"It is a major advance," said Dr. John Buse of the University of North Carolina at Chapel Hill, a leading diabetes expert who had no role in the studies. Buse said he often recommends surgery to patients who are obese and can't control their blood-sugar through medications, but many are leery of it. "This evidence will help convince them that this really is an important therapy to at least consider," he said.

There were signs that the surgery itself ? not just weight loss ? helps reverse diabetes. Food makes the gut produce hormones to spur insulin, so trimming away part of it surgically may affect those hormones, doctors believe.

Weight-loss surgery "has proven to be a very appropriate and excellent treatment for diabetes," said one study co-leader, Dr. Francesco Rubino, chief of diabetes surgery at New York-Presbyterian Hospital/Weill Cornell Medical Center. "The most proper name for the surgery would be diabetes surgery."

The studies were published online by the New England Journal of Medicine, and the larger one was presented Monday at an American College of Cardiology conference in Chicago.

More than a third of American adults are obese, and more than 8 percent have diabetes, a major cause of heart disease, strokes and kidney failure. Between 5 million and 10 million are like the people in these studies, with both problems.

For a century, doctors have been treating diabetes with pills and insulin, and encouraging weight loss and exercise with limited success. Few very obese people can drop enough pounds without surgery, and many of the medicines used to treat diabetes can cause weight gain, making things worse.

Surgery offers hope for a long-term fix. It costs $15,000 to $25,000, and Medicare covers it for very obese people with diabetes. Gastric bypass is the most common type: Through "keyhole" surgery, doctors reduce the stomach to a small pouch and reconnect it to the small intestine.

One previous study tested stomach banding, a less drastic and reversible procedure for limiting the size of the stomach. This technique lowered blood sugar, but those patients had mild diabetes. The new studies tested permanent weight-loss surgery in people with longtime, severe diabetes.

At the Cleveland Clinic, Dr. Philip Schauer studied 150 people given one of two types of surgery plus standard medicines or a third group given medicines alone. Their A1c levels ? the key blood-sugar measure ? were over 9 on average at the start. A healthy A1c is 6 or below.

One year after treatment began, only 12 percent of those treated with medicines alone were at that healthy level, versus 42 percent and 37 percent of the two groups given surgery.

Use of medicines for high cholesterol and other heart risks dropped among those in the surgery groups but rose in the group on medicines alone.

"Every single one of the bypass patients who got to 6 or less got there without the need for any diabetes medicines. Almost half of them were on insulin at the start. That's pretty amazing," said a study co-leader, Dr. Steven Nissen, the Cleveland Clinic's cardiovascular chief.

An obesity surgery equipment company sponsored the study, and some of the researchers are paid consultants; the federal government also contributed grant support.

The second study was led by Dr. Geltrude Mingrone at the Catholic University in Rome, with Rubino from New York. It involved 60 patients given one of two types of surgery or medicines alone. The researchers set as their goal an A1c under 6.5 ? the level at which someone is considered to have diabetes.

Two years later, 95 percent and 75 percent of the two surgery groups achieved and maintained the target blood-sugar levels without any diabetes drugs. None of those in the medicine-alone group did.

There were no deaths from surgery and only a few complications. Four patients in the Cleveland study needed second surgeries, and two in the Italian study needed hernia operations. Doctors note that uncontrolled diabetes has complications, too ? many patients wind up on dialysis when their kidneys fail, and some need transplants.

An adult who has a body mass index (a calculation based on height and weight) of 30 or more is considered obese. That's 203 pounds or more for a 5-foot-9 man, for example.

The government recently lowered the criteria for use of gastric bands from a BMI of 35 down to 30 in diabetics or people with heart disease, opening the way for wider use of this and other procedures for obesity.

Dr. Alvin Powers, director of the Vanderbilt University diabetes center, said the results are very encouraging for people like those in these studies ? very obese, with diabetes that can't be controlled through less drastic means.

"We still don't know the long-term outcomes of these surgeries" and whether the benefits will last for more than a few years, he said.

Others were more positive.

The studies "are likely to have a major effect on future diabetes treatment," two diabetes experts from Australia, Dr. Paul Zimmet and George Alberti, wrote in an editorial in the medical journal. Surgery "should not be seen as a last resort" and should be considered earlier in treating obese people with diabetes, they wrote.

Jon Diat is a success story. Diat, 50, who works at Citigroup and lives in New York, had been piling on pounds and pills for cholesterol and high blood pressure. After he needed an artery-opening procedure he was diagnosed with diabetes, but medicines for that failed to keep his disease under control and worsened his obesity.

"I was maxed out on the medications. It was very grim," he said. Two years ago, he had weight-loss surgery from Rubino.

"They told me, 'You're going to see rapid results,' but it was amazing. I literally lost 70 pounds in the first three months," he said. "I was off insulin within less than 72 hours of surgery. I am in complete, total remission of diabetes. My blood sugars are normal."

Now he eats right, plays tennis and hockey, walks the two miles home from work and takes 12 flights of stairs to his apartment.

"I look at this as a second chance at life," he said. "It's been liberating."

Tamikka McCray, 39, who also lives in New York and works for the city's Human Resources Administration, also had success from her surgery a year and a half ago. When she left the hospital, her diabetes had disappeared before any major weight loss had a chance to occur.

"That was the crazy part," she said. "I didn't understand that when they came in and they checked it. My sugars were normal." She added: "I left the hospital with no medication. And I haven't been on anything since."

(AP) ? Urging Americans to "do some soul searching," President Barack Obama injected himself into the emotional debate over the fatal shooting of a teenager in Florida, turning the racially charged case into a personal matter for the nation's first black president.

"If I had a son, he'd look like Trayvon," Obama said Friday.

Obama's words also catapulted the death in Florida of 17-year-old Trayvon Martin, already the focus of major national attention, into the presidential campaign. Three Republicans seeking Obama's job all used the word "tragedy" to describe the shooting, as the president did.

"I can only imagine what these parents are going through, and when I think about this boy, I think about my own kids," Obama said at the White House.

Obama said the parents of Martin, who was shot on Feb. 26 in Sanford, Fla., a suburb of Orlando, have a right to expect "that we're going to get to the bottom of exactly what happened."

Martin was shot by neighborhood watch volunteer George Zimmerman, who said he was acting in self-defense. Zimmerman's father is white, and his mother is Hispanic. The shooting has stoked debate over race as well as other issues. Obama did not mention Zimmerman in his comments.

Republican presidential candidates quickly weighed in after Obama spoke.

Former Pennsylvania Sen. Rick Santorum called the shooting a "horrible case." Referring to Florida's "stand your ground" law, which gives people wide latitude to use deadly force rather than retreat during a fight, Santorum said: "Stand your ground is not doing what this man did."

Former Massachusetts Gov. Mitt Romney, campaigning in Louisiana, said the shooting was a "terrible tragedy, unnecessary, uncalled for, and inexplicable at this point."

Romney said it was "entirely appropriate for the district attorney to be looking into this and to have called a grand jury and to find out what the facts are. We hope that justice is done in this case."

Former House Speaker Newt Gingrich of Georgia also called it a tragedy and credited local authorities for empaneling a grand jury. "There's a point in there where there ought to be some kind of signal that's pretty clear that this is a guy who'd found a hobby that's very dangerous," Gingrich said of Zimmerman.

Florida is a large and diverse state that plays an influential role in presidential elections ? it was a deciding factor in the 2000 election following a lengthy recount. The Orlando area in central Florida is particularly important, acting as a bellwether for statewide elections.

The case resonates with many black Americans, a key voting group during Obama's 2008 election, who see it as an example of bias toward blacks. Civil rights groups have held rallies in Florida and New York, saying the shooting was unjustified. Of Sanford's 53,000 residents, 57 percent are white and 30 percent are black.

Obama directed his message to Martin's parents, saying, "I think they are right to expect that all of us as Americans take this with the seriousness that it deserves, and we're going to get to the bottom of what happened."

He said that "every parent in America should be able to understand why it is absolutely imperative that we investigate every aspect of this and everybody pulls together, federal state and local, to figure out exactly how this tragedy happened."

The White House had said earlier in the week that it was "not going to wade into a local law enforcement matter" though offering sympathies for Martin's family. But that changed when Obama answered a shouted question following a Rose Garden ceremony to announce the president's choice to lead the World Bank.

Obama cautioned before speaking that he must "be careful so we're not impairing any investigation." But he said he was glad the Justice Department was investigating and that Florida officials had formed the task force.

"I think all of us have to do some soul searching to figure out how did something like this happen, and that means we examine the laws and the context for what happened as well as the specifics of the incident," Obama said.

White House spokesman Jay Carney said later that the president "had thought about" the case and "was prepared to answer that question when he got it."

Martin's parents, Tracy Martin and Sybrina Fulton, thanked Obama for his support, saying in a statement the president's words "touched us deeply and made us wonder: If his son looked like Trayvon and wore a hoodie, would he be suspicious, too?"

NAACP President Benjamin Jealous said in an interview that Obama "spoke from the heart of a parent and the experience of a parent of color, but also from the pulpit of our national leader. And we needed to hear all of those things in this moment."

Obama, early in his term, also spoke out after the arrest of Henry Louis Gates Jr., a black Harvard University professor, by a white police sergeant in Cambridge, Mass.

Gates was arrested in his home after the police sergeant arrived to investigate a possible burglary. The charges were dropped, but Obama said the police had "acted stupidly." The president said later he should have expressed his concerns with different language and invited both Gates and Sgt. James Crowley to the White House for a chat and a beer.

The Justice Department and FBI have opened a civil rights investigation into Martin's death, and a grand jury is considering whether to charge Zimmerman. Martin's parents, civil rights activists and others who have reacted to the case say they won't be satisfied until Zimmerman is arrested.

Martin was returning from a trip to a convenience store when Zimmerman started following him, telling police dispatchers Martin looked suspicious. At some point, the two got into a fight, and Zimmerman pulled out his gun.

Zimmerman told police Martin attacked him after he had given up on chasing the teenager and was returning to his sport utility vehicle.

Police Chief Bill Lee stepped down temporarily this week to try to cool the building anger that his department had not arrested Zimmerman. Hours later, Gov. Rick Scott announced that the local state attorney, Norman Wolfinger, had recused himself from the case in hopes of "toning down the rhetoric" surrounding it.
